Privacy Policy of the Ormire.com Online Store

GENERAL PROVISIONS

The administrator of personal data collected through the Ormire.com Online Store is Absolutico Sp. z o.o., with its registered office at ul. Górska 73, 43-300 Bielsko-Biała, Poland, e-mail address: shop@ormire.com, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court in Bielsko-Biała, 8th Commercial Division of the National Court Register under KRS number: 0000544072, share capital: PLN 10,000 fully paid, NIP (Tax ID): 5472153073, REGON: 360802670 — hereinafter referred to as the "Administrator," who is also the Service Provider and the Seller of the Online Store.

The Client’s (Service Recipient’s) personal data is processed in accordance with the Act of 10 May 2018 on the Protection of Personal Data (Journal of Laws 2019, item 1719, as amended), the Act of 18 July 2002 on Providing Services by Electronic Means (Journal of Laws 2020, item 344, as amended), and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, "GDPR").

The Administrator exercises special care to protect the interests of data subjects, ensuring that the data collected is:

  • processed lawfully,

  • collected for specified, lawful purposes and not further processed in a manner inconsistent with those purposes,

  • factually correct and adequate in relation to the purposes for which it is processed,

  • stored in a manner which permits identification of the persons concerned for no longer than is necessary for the purposes of processing.

PURPOSE AND SCOPE OF DATA COLLECTION

The Seller processes the following personal data:

The Online Store processes your personal data for the following purposes:

  • First name and surname or company name – necessary for issuing a sales document and addressing the shipment;

  • Address or addresses (street, building and apartment number, postal code, city) – necessary for addressing the shipment, and in some cases, when the shipment address differs from the invoice address;

  • E-mail address – necessary for communication regarding order fulfillment;

  • Phone number – necessary when certain delivery methods are selected (required by carriers);

  • Tax Identification Number (NIP) – optionally provided when issuing a sales document to a business entity.

Furthermore, your personal data may be transferred to mBank S.A. ("Bank") in connection with:

  • providing the Online Store with the infrastructure to handle online payments (legal basis: Article 6(1)(f) GDPR),

  • the processing and settlement of online payments made by customers of the Online Store using payment instruments (legal basis: Article 6(1)(f) GDPR),

  • the verification by the Bank of proper execution of contracts concluded with the Online Store, particularly for the purpose of protecting the interests of payers in relation to complaints submitted (legal basis: Article 6(1)(f) GDPR).

The data provided by the Customer is processed, collected, and used by the Seller exclusively for the following purposes:

  • fulfillment of sales transactions for ordered products,

  • establishment, exercise, or defense of legal claims,

  • analytical, archival, and accounting purposes,

  • direct marketing of the Seller's products and services (only if the Customer has given prior consent).

The data will be processed based on Article 6(1)(b), (c), and (f) GDPR.

Data provided by the Customer may also be collected and used for the purpose of creating an order history, provided the Customer creates an account in the Online Store through the registration process.

Personal data is stored for a period of five years, counted from the end of the calendar year in which the last login occurred, or, in the absence of account creation, from the date of the last sale.

Recipients of Personal Data

  • If the Customer chooses delivery via postal mail, courier service, or pallet shipment, the Administrator shares the collected personal data (first name and surname, address, phone number, e-mail address) to the selected carrier or intermediary tasked with delivering the shipment, solely for the purpose and duration necessary for delivery.

  • Personal data necessary for invoicing (first name and surname, address, NIP) will be transferred to the accounting system operated by BESKID-LEX Sp. z o.o., located at ul. Górska 73, 43-318 Bielsko-Biała, Poland, for accounting purposes.

  • If the Customer chooses online payment or card payment methods, the Administrator shares the Customer’s personal data, only to the extent necessary for payment processing, with the selected payment service provider.

If using an external payment system, any data entered after being redirected to the payment operator's website is processed solely by the operator and is not accessible or stored by the Administrator.

The Online Store cooperates with the following payment operators:

  • PayU S.A. based in Poznań, Poland;

  • PayPal (Europe) S.à r.l. & Cie, S.C.A. based in Luxembourg;

  • Tpay.com operated by Krajowy Integrator Płatności S.A., based in Poznań, Poland.

The Administrator processes the following data of Service Recipients (Customers):

  • first name and surname,

  • e-mail address,

  • phone number,

  • address (street, building number, postal code, city).

For Customers who are not consumers (business entities), the Administrator additionally processes:

  • company name,

  • Tax Identification Number (NIP).

Providing personal data indicated above is necessary for the provision of Electronic Services within the Online Store or the conclusion of a Sales Agreement for Products.
The required data fields are indicated each time in the Online Store’s Terms and Conditions or at the time of service activation or order placement.

 

NEWSLETTER SUBSCRIPTION

In the case of subscribing to the newsletter and consenting to its receipt during the registration process or while placing an order, the Administrator processes personal data such as the e-mail address, to which commercial information from the Online Store will be sent.

The recipient may unsubscribe from the newsletter at any time, either by logging into their Customer Account in the Online Store or by clicking the unsubscribe link included in the footer of each newsletter.


ADDITIONAL PROCESSING OF NON-ESSENTIAL DATA

If personal data not necessary for the fulfillment of an order or legal obligations is provided (e.g., through correspondence with the Online Store, withdrawal forms, warranty or guarantee claims), such data will be promptly deleted or anonymized and will not be processed by the Administrator.


COOKIES AND USAGE DATA

Cookies are small text files stored on the end device of the website visitor (e.g., hard drive, smartphone memory) sent by the server of the Online Store.

The Service Provider processes data contained in cookies while visitors use the Online Store website for the following purposes:

  • Identifying Service Recipients as logged in users and maintaining their session;

  • Remembering Products added to the shopping cart;

  • Remembering data entered into Order Forms, surveys, or login data;

  • Adjusting the content of the Online Store to the individual preferences of the Service Recipient (e.g., colors, font size, page layout);

  • Conducting anonymous statistics about how users interact with the Online Store website to better understand user needs (without identifying individual users).

Default settings in most web browsers allow cookies to be stored on end devices.
Each user can configure the handling of cookies in the browser settings — this includes partial or complete blocking of cookies. However, blocking cookies may affect the functionality of the Online Store (e.g., completing an order might become impossible).

The Service Provider also processes anonymized usage data ("logs" such as IP addresses, domain names) for statistical and administrative purposes. These logs are anonymous and do not identify specific visitors.
Logs are not disclosed to third parties.


LEGAL BASIS FOR DATA PROCESSING

Providing personal data by the Service Recipient/Customer is voluntary but necessary to conclude a Sales Agreement or an Electronic Services Agreement.
The scope of required data is indicated in the Terms and Conditions and during the order process or service activation.

The legal basis for the processing of personal data is:

  • The necessity to perform the contract to which the Service Recipient/Customer is a party, or to take actions at the request of the Service Recipient/Customer prior to concluding the contract;

  • In cases of direct marketing of the Administrator’s own products or services — the Customer's prior consent.


RIGHTS OF THE DATA SUBJECT

The Service Recipient has the right to:

  • Access their personal data,

  • Request correction, updating, or completion of their data,

  • Request temporary or permanent suspension of processing,

  • Withdraw consent for processing at any time,

  • Request deletion of their data,

  • Request anonymization of their data,

  • Lodge a complaint with the competent supervisory authority (President of the Personal Data Protection Office in Poland).

In cases where data is processed for direct marketing, the data subject may object to the processing due to their particular situation.

Rights can be exercised via the Customer Account or by contacting the Administrator via e-mail at shop@ormire.com or by postal mail to the Administrator's address.

The Administrator shares personal data only with authorized entities on the basis of legal agreements for data processing, ensuring the highest standards of protection, confidentiality, and data security.


FINAL PROVISIONS

The Online Store may contain links to other websites.
The Administrator encourages users to review the privacy policies of those websites after leaving the Online Store.
This Privacy Policy applies solely to the Ormire.com Online Store.

The Administrator implements technical and organizational measures to ensure an adequate level of security for personal data processed, especially to protect the data from unauthorized access, unauthorized modification, loss, or destruction.

Technical safeguards include:

  • Protection of the data set against unauthorized access,

  • Secure login procedures (individual login and password),

  • SSL certificates ensuring encrypted communications,

  • Antivirus protection and access control systems.

The Online Store does not collect any information automatically, except for information contained in cookies.
